What Is California Lemon Law?

The Lemon Law in California is legally entitled the Song-Beverly Consumer Warranty Act under California Civil Code §§ 1790 et seq. This statute provides consumer protection for those who purchase or lease a vehicle that continues to have a defect after a reasonable number of repair attempts, requiring the vehicle’s manufacturer to buy back the vehicle or replace it. Under the Lemon Law, the repurchase of a defective vehicle by the manufacturer must include reimbursement of the vehicle’s down payment, monthly payments made, and the remaining balance of the loan.

Does My Vehicle Qualify as a Lemon?

The term, “reasonable number of repair attempts” is analyzed on a case-by-case basis. However, your vehicle presumptively qualifies if it meets certain conditions. A vehicle is presumed to be a lemon and qualifies for a buyback or replacement under the following conditions:

  • The defect first appeared within 18 months of the vehicle’s purchase or the first 18,000 miles driven
